Former Town of Lenox highway employee arrested for fraud, falsifying business records

LENOX, N.Y. — The New York State (NYS) Police announced that its special investigations unit recently arrested a Town of Lenox Highway Department employee for three crimes related to fraud and falsifying business records.

Adam C. Cesario, age 36, of Lenox, was charged with 5th degree tax fraud, offering a false instrument for filing in the 2nd degree, and 2nd degree falsifying business records — all misdemeanors.

 The charges stem from an NYS Police investigation that revealed that Cesario, while working as an employee for the town’s highway department, allegedly used its tax-exempt account to evade sales tax on purchases related to a “personally owned auto repair shop,” according to an NYS Police news release.

The business that Cesario was operating was not a registered auto repair shop, Trooper Jack L. Keller, public information officer, says in an email response to a BJNN inquiry. “He was doing auto repair work for people at his residence and being paid under the table,” he adds.

The investigation also determined that Cesario had claimed on a time sheet to have been working at the Town of Lenox Highway Department, when he was not.

 Cesario was processed and issued an appearance ticket to return to the Village of Canastota Court.
